Terms of Service

1. Acceptance of Terms

By accessing or using welago (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. These Terms apply to all visitors, users, registered account holders, and guests who access the Service via an invite link.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and references to "you" include that organization.

2. Description of Service

welago is a group trip planning platform that allows users to create and join trips, coordinate travel plans, communicate with trip participants, vote on dates and destinations, and access links to external travel services through affiliate partner links. The Service is provided by TripDip LLC dba welago ("Company," "we," "us," or "our"), operating at welago.com.

We reserve the right to modify, suspend, or discontinue the Service or any feature at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuance.

3. User Accounts

• Certain features of the Service are available without a registered account, such as accessing a trip as a guest via an invite link. However, creating an account unlocks full organizer and member functionality.
• Account creation requires a valid email address. You must provide accurate, current, and complete information and keep it up to date.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You may not share your account with others, use another person's account, or create accounts using automated means.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or remain inactive for extended periods, at our sole discretion.

4. User Conduct

You agree not to use the Service to:

• Post, transmit, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Harass, bully, or intimidate other users or trip participants
• Impersonate another person, user, or entity, or falsely claim affiliation with any person or organization
• Use the Service for spam, unsolicited advertising, or commercial solicitation without our consent
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or connected systems
• Scrape, crawl, or collect data from the Service using automated tools without written permission
• Introduce viruses, malware, or other harmful code into the Service
• Violate any applicable local, state, national, or international laws or regulations

We reserve the right to investigate and take appropriate action, including removing content and terminating accounts, for violations of this section.

5. Trip Content

• You retain ownership of the content you create within the Service, including trip details, itinerary items, comments, and messages.
• By submitting content to the Service, you grant welago a limited, non-exclusive, royalty-free license to store, display, and transmit that content solely for the purpose of operating the Service and making the content available to relevant trip participants.
• You are solely responsible for the accuracy and legality of travel details, dates, links, and any other information you enter. welago does not verify user-submitted content.
• welago is not responsible for disputes, conflicts, or disagreements between trip members, organizers, or guests. Any such disputes are between the parties involved.

6. Travel Links & Affiliate Partners

welago provides links to third-party travel services, including hotels, flights, activities, car rentals, and eSIMs. All transactions are made directly with those third-party providers. welago is not a travel agency and is not a party to any booking transaction between you and a travel provider.

welago expressly disclaims responsibility for:

• The accuracy of pricing, availability, or descriptions shown on third-party sites
• Booking errors, cancellations, or overbooking by travel providers
• Refunds, which are governed solely by the travel provider's policies
• Travel disruptions, delays, lost luggage, or any travel-related incident

welago participates in affiliate programs and may earn a commission when you complete a booking through our affiliate links. This commission is paid by the provider and does not affect the price you pay.

7. Intellectual Property

The welago name, logo, brand identity, and all original content created by TripDip LLC dba welago — including website design, interface elements, marketing copy, and documentation — are the exclusive property of TripDip LLC dba welago and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works based on welago's intellectual property without prior written permission. Unauthorized use may result in legal action.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

8b. Sensitive Data & Shared Content

welago provides collaborative tools — including shared spreadsheets, discussions, media uploads, and travel coordination features — that allow trip members to share information with each other.

You are solely responsible for the content you enter, share, or upload. This includes personal information such as passport numbers, booking references, login credentials, addresses, and other sensitive data. welago does not review, moderate, or validate user-entered content.

Access control: Shared trip content (discussions, sheets, media, travel details) is visible to all authenticated members of that trip. Content is not accessible to users who are not signed in or not a member of the trip. However, welago cannot guarantee that other trip members will handle your shared information responsibly.

Recommendations for sensitive data:

• Use the My Space tab (private, visible only to you) for highly sensitive information like passwords, full passport numbers, or financial details
• Only share information in shared spaces (sheets, discussions, media) that you are comfortable with all trip members seeing
• Avoid sharing complete government ID numbers, full credit card numbers, or passwords in shared areas
• Consider using partial or masked values when sharing sensitive references (e.g., last 4 digits only)

TripDip LLC dba welago is not liable for any loss, damage, or misuse resulting from sensitive information you choose to share with other trip members through the Service. By entering sensitive data into shared features, you accept full responsibility for that decision.

8c. Communications & Messaging Consent

By providing your phone number and/or email address to welago — whether during account creation, profile setup, or when opting in to trip notifications — you expressly consent to receive communications from welago related to the Service. These communications may include:

• SMS/text messages: trip notifications, RSVP updates, discussion alerts, live session invitations, phone verification codes, and other trip-related messages
• Voice calls: conference call connections for live discussion voice chat sessions initiated by trip organizers or members
• Email: trip activity notifications, daily digests, account verification, and service-related announcements

Opt-in and opt-out: By creating an account, you agree to receive email notifications related to trip activity, including RSVP updates, discussion messages, itinerary changes, and expense activity. Email notifications are enabled by default and can be managed or disabled at any time from your Profile page under "Notification Preferences." SMS notifications require explicit opt-in via your Profile settings. Voice chat is initiated on-demand — you will only receive a voice call when you actively join a live discussion voice session or when a trip organizer initiates a conference call to your registered phone number.

Message frequency: Message frequency varies based on trip activity. welago limits notifications to a maximum of one SMS and one email per trip every 15 minutes to prevent excessive messaging. You may receive additional messages for time-sensitive events such as live session invitations.

Standard rates apply: Message and data rates may apply for SMS messages and voice calls depending on your mobile carrier and plan. welago is not responsible for any charges incurred from your carrier.

Third-party providers: welago uses third-party communication providers (including Twilio and AWS) to deliver SMS messages, voice calls, and email notifications. By consenting to receive communications, you acknowledge that your phone number and/or email may be shared with these providers solely for the purpose of delivering Service-related communications.

To stop all SMS messages, reply STOP to any welago text message, or disable SMS notifications in your Profile. For help, reply HELP or contact support@welago.com.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

welago does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Information provided through the Service is accurate, complete, or reliable
• Defects in the Service will be corrected
• The Service or its servers are free of viruses or other harmful components

10. Limitation of Liability

To the maximum extent permitted by applicable law, TripDip LLC dba welago, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, statute, or any other legal theory.

Our total cumulative liability to you for any claims arising from your use of the Service is limited to the total amount you paid us in the twelve (12) months preceding the claim. For users who have not paid any fees, our total liability is limited to $0.00.

11. Indemnification

You agree to defend, indemnify, and hold harmless TripDip LLC dba welago and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your User Content.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware for resolution of any disputes arising from these Terms or your use of the Service.

13. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will notify you by email (to the address associated with your account) or by displaying a prominent notice within the Service. The "Last updated" date at the top of this page reflects the most recent revision.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
